Working together — the short version
This page explains, in plain words, what we promise you and what we ask of you. It is a summary of our full Terms & Conditions below. Please read it before paying your production deposit — it only takes two minutes.
What we promise you
- A free, detailed design. Your design deposit ($50 per wall) is not a design fee. It shows you are serious about the project and is credited in full towards your order.
- As many design changes as you need before you approve the final design. Change it once, twice or three times — no extra cost.
- The design is yours. If you decide not to go ahead, you keep the design and can use it to get quotes elsewhere. The design deposit stays with us.
- An honest estimate. Your final quote will stay within the margin stated in our estimate email (10% unless stated otherwise). If it goes above that margin and you haven’t changed the design, you can walk away and get your design deposit back.
- We look after the materials on delivery day and store them in a dry, covered place on your property.
- Time to check our work. You have 7 days after installation to look everything over and tell us about anything that isn’t right. We will come back and fix it.
- A 10-year warranty on everything we supply and install — materials, hardware and our workmanship. This is on top of your rights under Australian Consumer Law.
- Supplier discounts passed on to you. Our trade discount on materials is shown as a separate line on your invoice and applies when you pay on time.
What we ask of you
- Check the final design carefully. Paying the production deposit confirms you approve the design, and production starts. After that, changes may not be possible; if they are, they will be at your cost.
- Tell us early if you want to pay in instalments. Instalments are available with a 60% production deposit, and the balance can be spread over up to 12 months.
- Prepare a dry, covered space for delivery — ideally a clear area in your garage, or inside the house. We can’t leave materials outside. If there is no space on the day, we may need to reschedule, and delivery and setup would then be charged again.
- Have the work area ready as described in our pre-installation email — for example, empty old cabinets before we arrive. If the team has to wait, the first 30 minutes are free; after that, waiting time is charged.
- Pay the balance within 7 days of completion — or, within those 7 days, send us a list of anything to fix. In that case you pay the balance less 10%, and the remaining 10% once we’ve fixed the items.
- Please don’t move delivered materials without talking to us first.
The full Terms & Conditions below explain the details. When you pay your production deposit, you will be asked to confirm that you have read and accept them.
Terms & Conditions
These Terms & Conditions apply to every design, supply and installation job carried out by Lev Gorfunkel, ABN 57 754 152 450, trading as Fit My House (“we”, “us”, “our”), for a customer (“you”, “your”). Nothing in these terms excludes, restricts or modifies any right you have under the Australian Consumer Law.
1. Our services
1.1. We design, supply and install custom cabinetry and related products (the “Work”).
1.2. Your order is made up of: the approved design, our quote or invoice, and these Terms & Conditions. If they conflict, the approved design and the quote prevail over these terms.
1.3. Unless your quote says otherwise, the Work does not include plumbing, electrical, gas, tiling, plastering, painting, removal of old cabinetry or stone benchtops. Where these are needed, you arrange them, or we can quote for them separately.
1.4. We service the areas listed on our website.
2. Design deposit and estimate
2.1. Before we start your design, we ask for a design deposit (currently $50 per wall). It is not a fee for the design: it confirms your commitment, and it is credited in full against your order if you go ahead.
2.2. Before you approve the final design, you may ask for as many changes as you need at no extra cost.
2.3. If you decide not to proceed with production, the design deposit is not refunded, as it covers part of the design work. The design itself becomes yours, and you may use it for any purpose, including obtaining quotes from other suppliers.
2.4. Our preliminary estimate is a guide. The final quote may differ from it by up to the margin stated in our estimate email, or by up to 10% if no margin is stated.
2.5. If the final quote exceeds the estimate by more than that margin, and the increase is not caused by changes you requested (for example, a larger scope, different materials or extra items), you may decline to proceed and we will refund your design deposit in full.
3. Production deposit and design approval
3.1. When the design is final, we send you the design together with an invoice for the production deposit. The production deposit is 50% of the order total, or 60% if you choose to pay the balance in instalments (clause 7).
3.2. Please check the design carefully: materials, colours, layout and dimensions. By paying the production deposit you confirm that you approve the design and that it is what you want us to make. We then start production.
3.3. After the production deposit is paid, changes to the design can be made only if we agree and production still allows it. Any change is at your cost, and we will confirm the cost in writing before making it.
3.4. Production and delivery dates are our best estimate. They may change because of manufacturer lead times or events outside our control. We will keep you informed and agree a new date with you.
4. Preparing for delivery
4.1. Before your installation date, we email you a list of what needs to be ready. Please follow it.
4.2. On delivery day you must provide a dry, covered space where the flat-packed materials can be stored and assembled — preferably a clear area in your garage, or otherwise inside the house. We will not leave materials outdoors.
4.3. If on the day there is no suitable space and we have to cancel the delivery or installation, we may charge the delivery and setup amounts shown on your invoice again for the rescheduled visit.
4.4. Once materials are delivered and placed by us, please do not move them without talking to us. If you or anyone on your behalf moves the materials without our agreement and they are damaged, you are responsible for that damage.
5. Preparing the work area and waiting time
5.1. The work area must be ready before we arrive, as described in our pre-installation email — for example, existing cabinets emptied and the area clear of personal items.
5.2. If the area is not ready and our team has to wait, or clear the area ourselves, the first 30 minutes are free. After that, we may charge waiting time at 50% of the setup amount on your invoice for each hour (or part of an hour) for the whole team.
6. Ownership and risk
6.1. The materials and cabinetry remain our property until the order is paid in full.
6.2. Materials such as laminate and stone may differ slightly in colour, pattern or texture from samples, brochures or on-screen images. This is not a defect.
7. Payment of the balance
7.1. All prices include GST unless stated otherwise.
7.2. You can pay the balance in one of two ways:
(a) in full (see clause 8 for timing); or
(b) in instalments over a period you choose of up to 12 months, with no interest or fees. You must tell us that you want instalments before we send the production deposit invoice; the production deposit is then 60%. We will agree the instalment schedule with you in writing.
8. Checking the Work and paying the balance
8.1. When installation is complete, you have 7 days to check the Work. Within those 7 days you must either:
(a) pay the balance (or the first instalment, if you pay in instalments); or
(b) send us, in writing, a list of the items that need fixing.
8.2. If you send a list, you pay the balance less a retention of 10% of the order total within the same 7 days. We will fix the listed items as soon as practicable.
8.3. You pay the 10% retention within 7 days after we complete the fixes. In that period you may only raise items that were not fixed properly; anything new is handled under our warranty (clause 11), and does not delay payment.
8.4. The due date for each payment is the date set out in this clause or in your instalment schedule.
9. Trade discount for materials (on-time payment)
9.1. Our prices are our full prices. We offer you a discount equal to the discounts our suppliers give us on materials, on the condition that you pay on time. The discount appears on your invoice as a separate line, “Trade Discount for Materials (applies when paid on time)”.
9.2. The discount applies only if each payment is made by its due date. If a payment is late, we will first send you a friendly reminder, and if it is still unpaid 14 days after the due date, a written notice. If payment is received within 14 days of that notice, you keep the discount. Otherwise, the discount does not apply, and the full price becomes payable: the discount amount is added to your balance.
10. Late payment
10.1. Overdue amounts attract interest at the rate fixed from time to time under the Penalty Interest Rates Act 1983 (Vic), from the due date until payment is received.
10.2. If we have to take steps to recover an overdue amount, you must pay our reasonable costs of recovery, including collection agency and legal costs, to the extent permitted by law.
11. Our 10-year warranty
11.1. We warrant the cabinetry, materials and hardware we supply, and our installation workmanship, against defects for 10 years from the date of installation.
11.2. To make a claim, contact us at admin@fitmyhouse.com.au or 0400 299 793 and describe the problem, with photos if possible. We will inspect it and repair or replace the defective item at our cost, as soon as practicable. You bear any costs of making a claim, such as your own phone or postage costs.
11.3. The warranty does not cover damage caused by:
(a) misuse, accident or neglect;
(b) water leaks, flooding or excessive moisture or heat;
(c) modification, repair, removal or reinstallation by anyone other than us;
(d) normal wear and tear.
11.4. This warranty is given by Lev Gorfunkel, trading as Fit My House, ABN 57 754 152 450, Point Cook VIC 3030, 0400 299 793, admin@fitmyhouse.com.au.
11.5. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. The benefits of this warranty are in addition to other rights and remedies you have under the law.
12. Cancellation
12.1. Before you pay the production deposit, you may cancel at any time; clause 2.3 applies to the design deposit.
12.2. After the production deposit is paid, your cabinetry is made to order and cannot be resold. If you cancel before we place your order with the manufacturer, we will refund the production deposit in full. If you cancel after the order has been placed, the production deposit is not refunded, and if our costs already incurred exceed the deposit, you must pay the difference.
13. Disputes
13.1. If you are unhappy with anything, please contact us first — we will do our best to resolve it quickly.
13.2. If we cannot resolve it together, either of us may contact Consumer Affairs Victoria or apply to the Victorian Civil and Administrative Tribunal (VCAT).
14. Privacy
14.1. We collect your personal information only to provide the Work, communicate with you and manage payments. We handle it in accordance with the Privacy Act 1988 (Cth) and do not sell or share it, except where required by law or where needed to recover an overdue debt.
14.2. We may photograph the finished Work for our portfolio and website. We never show your name or address. Tell us if you would prefer us not to use photos of your project.
15. General
15.1. Notices may be given by email, SMS, post or in person, using the contact details last provided.
15.2. We may update these Terms & Conditions from time to time. The version that applies to your order is the one in force on the date you paid your production deposit.
15.3. These terms are governed by the laws of Victoria, Australia.
